Codemasters has filed a civil complaint against Gazillion and NetDevil in a San Francisco federal court. According to the suit, the agreement between the publisher and the developer stated that the game was to be shipped on or prior to February 29, 2009. In addition to the release of the game, there were also agreements regarding the placing of the source code fort he project in an escrow account by a specified date.
Codemasters is seeking damages stemming from a breach of the contract and court approval to rescind the agreement that it entered into with NetDevil with a return of all funds provided to the development studio for the game’s design. Long story short, we are likely to see the game undergo further delays as the courts attempt to sort all of this out...
