Eurogamer has revealed that Microsoft has changed the way
Kinect detects you now. Initially, the base node at which the system would generate the skeleton started at the pelvis. Microsoft changed it to start at the neck, so now all's right in the world of couch sitting gamers. It also helps with those lying on the ground, like if you wanted to perform a sit up or push up in exercise games.
Now, if they could just make it a little less laggy....
